These Website Terms and Conditions (“Terms”) govern your access to and use of the website operated by Revenue Security Services (“RSS,” “we,” “us,” “our”) (the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

This is a baseline template. You should have counsel align it to your actual operations, regulatory posture, and tech stack.

1. Scope:

The Site is informational and is not, by itself, a contract for RSS services. Any services RSS provides to business clients are governed by separate written agreements (“Client Agreements”). If there is a conflict between these Terms and a Client Agreement, the Client Agreement controls for the services it covers.

2. Eligibility:

You represent that you are at least 18 years old and have authority to agree to these Terms on behalf of yourself and/or the organization you represent.

3. Acceptable use:

You agree not to:

• Use the Site for any unlawful, fraudulent, abusive, or deceptive purpose.
• Attempt to gain unauthorized access to the Site, systems, or networks (including scanning, probing, or scraping).
• Introduce malware, automated bots, or anything that degrades availability or performance.
• Misrepresent your identity or affiliation.
• Use the Site to submit sensitive personal information unless expressly requested via a secured workflow.

RSS may suspend or block access at any time if we determine (in our discretion) that your use creates risk, abuse, or operational disruption.

4. No consumer payment portal:

Unless explicitly stated on the Site, the Site is not a consumer payment portal and is not intended for submitting time-sensitive disputes or legal notices. Do not send bank account numbers, full SSNs, or other highly sensitive data through general webforms or email.

5. Intellectual property:

The Site and its content (text, graphics, logos, designs, software, and compilation) are owned by RSS or its licensors and are protected by applicable intellectual property laws. You may view and print pages for internal, non-commercial use only. You may not copy, modify, distribute, sell, or create derivative works without RSS’s prior written permission.

6. Third-party links:

The Site may include links to third-party sites. RSS does not control those sites and is not responsible for their content, policies, or practices. Links are provided for convenience and do not imply endorsement.

7. Disclaimers:

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” RSS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

The Site may describe RSS capabilities at a high level. Actual program terms, underwriting criteria, approvals, service levels, and pricing (if any) are governed by Client Agreements and operational rules.

8. Limitation of liability:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RSS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RSS’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED $100.

9. Indemnification:

You agree to defend, indemnify, and hold harmless RSS and its affiliates, officers, directors, employees, and agents from and against claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, violation of these Terms, or infringement of any rights.

10. Privacy:

Your use of the Site is subject to the RSS Privacy Policy, which is incorporated by reference into these Terms.

11. Changes to the Site or Terms:

RSS may update the Site or these Terms at any time. Changes are effective when posted with an updated Effective Date. Continued use of the Site after changes are posted constitutes acceptance.

12. Termination:

RSS may terminate or restrict your access to the Site at any time, with or without notice, if we believe your use creates risk or violates these Terms. Sections that by their nature should survive will survive (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law).

13. Governing law; venue:

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute arising out of or related to the Site or these Terms will be brought exclusively in the state or federal courts located in Bexar County, Texas, and you consent to personal jurisdiction and venue there.
